1848-1850

Wharton County Sheriff



H.H. Higley was born in Conneticut in 1810. He worked as a carpenter before becoming Sheriff. He was sheriff of Wharton County from 1848 to 1850 serving only one term.

He also worked as a Bailiff for the courts as well as doing repairs on the Courthouse during and after his term expired as Sheriff.

At the time Higley was elected as our second sheriff of Wharton County we did not have a jail. It was during his term as Sheriff that the County Commissioners court decided to propose a new jail building. Although it would not be built during his office. From County Court records in the August Term 1848 it is written:

H.H. Higley presented his bond as Sheriff of Wharton County, which was received & approved the court then adjourned to the first monday in Sept next.

H.H. Higley presented his account against the county for services as Sheriff from Spring term of the district court to the fall term of the same 1848 for twenty five dollars. It is ordered by court that said account be audited and paid out of any money in the County Treasurer not otherwise appropriated & that the County clerk is hereby required to draw a draft in Said Higlkeys fav. for said amount. The court then adjourned to the next regular time.

Higley presented his account of Four. 38/100 dollars for repairs done on the court house which was examined and allowed & ordered to be filed paid Ordered by the Court that the same Revenue tax be levied and collected for the use of this county that was levied last year, viz one half of theamount levied by the state. The court adjourned to the next regular term....

It is ordered by the Court that the said account be filed and paid by the clerk issuing a warrent on the county treasury for the amt.

County Commissioners Court

H.H. Higley Sheriff of Wharton County presented his a/c against said County for his services in waiting on the District Court & inferior Courts at March term of said District Court 1850 $25.00 also accounts for Baliff attending the March term of the district Court that is to Geo. W. Wallace $6.00 six dollarts & to L.H. Kincheloe &4.50 four dollars fifty cents. It is ordered by the Court that the clerk draw on the county Treasury for the above stated amounts.

[Note: In July 1850 Robert E. Davis was elected Sheriff having received 106 votes, as it shows in the Court minutes.]

H.H. Higley presented his account for work done in repairing the Judges bench in the Court House & filling Court House windows with Glafse for fourteen dollars and sixty cents, which was allowed & approved & ordered to be paid by draft on the County Treasurer.
