J.D. Newell

Another prominent man of Fort Bend County, came from North Carolina to Texas in 1830, and was a member of the convention in 1833. He was a successful planter, and lived to make forty-five crops in Texas. He died in Richmond, Fort Bend County, in December 1875.

Oct 1854 J. T. Hefford vs. J.D. Newell

Signed a bank note for six hundred fifteen dollars on 29 May 1854 in Matagorda called "bill of exchange" and delivered it to Samuel Fisher and the bill was drawn on Miss Clements and Miss Hayden of New Bank for $535.67 payable in 60 days - after date in favor of Samuel Fisher. Samuel Fisher gave Newell the money. When Fisher wanted his money from the ladies they refused to pay it.

March 7, 1856 John D. Newell vs. John L. Croom

Newell says that Croom owes him $360.00 plus interest from 10 Dec 1855. Croom owed Newell money or services and Croom agreed to pay a debt of Newells in exchange. Croom signed a note promising to pay another party John Royall the amount and never pays it, so Newell is suing him for it. The promissory note is attached to the court document.

First page says "suit pending" Answer Defendant (Miles) denies all allegations

2nd - Amended answer:

Evidentially the above missing case was over a disagreement over the sale of some Negros or a negro boy. One negro boy (John) had a disease at time of sale. And further states that he bought of Newell over $6560.00 worth of stock, horses, mules colts etc and when he delivered them and Miles took them to Missouri they all died on the trip because they were diseased. He (Miles) says Newell knew they were diseased at the time of sale and wants restitution for the stock plus all expenses for the trip that he has paid out and court costs.

3rd Paper - Sept 26, 1861 application for ranch, garnishment of wages J.D. Newell vs. J. Miles

Newell states that Mrs. Craig and Thomas Sweeney and E. W. Crews of Brazoria Co are severally indebted to defendant in large sums of money and wants to summon them to court in order to garnish money from them to pay the debt that Miles owes him.

4th Paper - Oct 21, 1861 Garnishment for E. W. Crews

J. Newell vs. J. Miles

on 19th of Sept.1861 sued against the property of J. Miles and therefore command E. W. Crewes to appear in court to answer for his indebtedness to J. Miles.

This case took place in Fort Bend when Newells wagon was hit and destroyed by a train. He sued the RR co but because "there exists in said Fort Bend County so great a prejudiced [?aqcuish?] it that it can not obtain a fair and impartial trial in said county".
