This is the last will and testament of me Potter Samuel Oyler of Commercial Street Spitalfields in the County of Middlesex Fruit Salesman I appoint my dear wife Mary Ann Oyler and my sons Thomas Potter Oyler and George Benjamin Oyler Executrix and Executors of this my will     I give and bequeath to my said wife Mary Ann Oyler all my furniture plate linen china books pictures prints and other household effects to and for her own use absolutely   

And subject to the payment of my debts except  monies owing on mortgage on my free hold property for the payment of which I have hereinafter provided and to the payment of my funeral and testamentary expenses I give and bequeath to my said wife Mary Ann Oyler and my said sons Thomas Potter Oyler and George Benjamin Oyler their executors and administrators my leasehold premises in Commercial Street aforesaid on part of which my business as a fruit salesman is carried on and my store in trade business utensils books debts ready money and all other my personal estate in whatsoever an whosoever in trust therewith to continue and carry on  jointly the said business of a fruit salesman and to apply the annual profits to the said business and my money or other personal estate and xxxxx arising from personal estate that shall not be required for carrying on the said business for the profit of themselves and the main xxxxxx and bringing up of my children in such manner and such proportions as they the said Mary Ann Oyler Thomas Potter Oyler and George Benjamin Oyler or the survivors of them shall mutually agree upon and in their xxx jointly think best

And as to all my freehold property at Leytonstone  and Bromley by Bow or elsewhere I xxxx the same unto my said wife Mary Ann Oyler and my said sons Thomas Potter Oyler and George Benjamin Oyler and the survivors and survivor of them her or his heirs and assigns in trust in the first place to pay and apply the whole of the annual rents and profits of the same in discharging the principal monies owing on mortgages on parts of the same or the installments thereof as they become payable and in paying the interest but from time to time thereon 

And as soon as my said freehold properties are all free from the mortgage debts upon them or any of them then I direct that my said trustees shall stand possessed of the same upon the trusts following that is to say as to my soon houses at Leytonstone in trust to pay and apply the annual rents and profits of the same xxxing  the life of my said Mary Ann Oyler to have for her separate use or to xxx her to xxx the same and from and after her xxx in trust for such of my children Harriet Payne Thomas Potter Oyler and George Benjamin Oyler Elizabeth Oyler William Oyler Frances Oyler Henry Oyler Alice Oyler Jessy Oyler and Benjamin Oyler as shall be living at her xxx and the issue or xxx of them as shall xxx xxx xxx leaving issue living their heirs and assigns responsibly in mutual shares and proportions as tenants in common and not as joint tenants xxxx  xxxxx however to take only the share or shares which the parent or parents or such issue would have taken if living

And as to my other freehold property at Bromley by Bow or elsewhere and the rents and profits thereof in trust for such of all my said children as shall live to attain the age of twenty one years and this your or such of them as shall be under that age leaving issue their heirs and assigns respectively in equal shares and proportions as tenants in common such issue taking  only the share or shares which the parent or parents would have taken if living  
And I empower my said trustees to apply the shares of any of my said children or issue or any of them in the said last mentioned rents and profits owing/owning his or her minority in or towards maintenance and duration of advancement positively  

And I direct that all monies payable under this my will and property given to or in trust for females shall be for their sole and separate use free from the control debts or engagements any husbands to whom they may respectively be married and the xxxx of such females about but not by way of arbitration shall be good discharges to my executors and trustees respectively for the same 

And hereby revoking all other wills by me heretofore xxxx  I declare this to be my last will and testament witness my hand this fourteenth day of January one thousand eight hundred and sixty eight  ------ Potter Samuel Oyler  ----- signed and declared by the testator as his last will and testament in the presence of us both of us being present at the same time who in his presence at his xxxxx and in the presence of each other hath subscribed our names hereto as witnesses ------ W. Proved at London 19th March 1868 by the oaths of Mary Ann Oyler Widow the Relict and  Thomas Potter Oyler and George Benjamin Oyler the sons the Executors to whom xxxx was granted

Transcript of Will
This is the last will and testament of me Mary Ann Oyler of The Elms Cheshunt Park Farm in the County of Herts. widow     I hereby revoke all former wills and testamentary dispositions heretofore made by me I bequeath all my household furniture plate linen china and other household effects and all my ready money money in the funds shares and any interest in any businesses and all other my personal estate and effects whatsoever of which I shall be possessed at the time of my decease or over which I shall have any disposing power unto my son William Oyler of the Bridge House Tavern Whitmore Road Hoxton Licensed Victualler and Thomas Redburn of Ponders End in the Parish of Enfield in the said county of Middlesex Job Master
whom I have hereinafter appointed my executors their executors or administrators upon trust as to such part thereof as shall consist of share in the Enfield Independent Benefit Building Society for my youngest son  Benjamin Oyler and as to the residue thereof upon trust to call in sell and convert into money such parts as shall not consist of money and out of the money thereby and of the money of which I shall be possessed at my death in the first place to pay my funeral and testamentary expenses and just debts and to stand possessed of the residue of all such moneys upon trust to pay and divide the same lo between and among my eight dear younger children hereinafter named in equal shares and proportions namely my daughter Harriet the wife of  Joseph Langbridge my daughter Elizabeth the wife of James Kipping of white Horse Street Stepney Fruiterer my son the said William Oyler my daughter Frances the wife of George Stevens of Bethnal Green Road Fruiterer my son Henry Oyler my daughter Alice the wife of the said Thomas Redburn my daughter Jessey the wife of James Napier Fillans and my said son Benjamin Oyler

And I hereby declare that the shares of my said daughters shall be for their sole and separate use and free from the debts control or engagements of their present or any future husbands And I direct that in case the said Benjamin Oyler shall die under the age of twenty one years my said executors shall stand possessed of the shares of my said estate hereby given in trust for him upon trust to pay and divide the same lo between and among the others or other of my said eight younger children in equal shares and proportions in the same manner as before directed concerning their original shares

And I hereby appoint the said William Oyler and Thomas Redburn Executors of this my last will and testament in witness whereof I have hereunto I have set my hand this fourth day of January one thousand eight hundred and eighty two  -- Mary Ann Oyler – signed and declared by the said Mary Ann Oyler the testatrix as and for her last Will and Testament in the presence of each other at the same time have here unto subscribed our names as witnesses – J.R. Rignall Enfield Middlesex Solicitor  George Stannard his clerk

On the fourth day of August 1886 probate of this Will was granted to William Oyler and Thomas Redburn the Executors
